f) If  t he Product  is ret urned t o NMP during t he limit ed warrant y 
period, but  t he problem wit h t he Product  is not  covered under t he 
t erms and condit ions of t his limit ed warrant y, t he Consumer will 
be not if ied and given an est imat e of  t he charges t he Consumer 
must  pay t o have t he Product  repaired, wit h all shipping charges 
billed t o t he Consumer. If  t he est imat e is refused, t he Product  will 
be ret urned f reight  collect . If  t he Product  is ret urned t o NMP aft er 
t he expirat ion of t he limit ed warrant y period, NMP's normal 
service policies shall apply and t he Consumer will be responsible 
for all shipping charges.

9. The Product  consist s of newly assembled equipment  t hat  may 
cont ain used component s t hat  have been reprocessed t o allow 
machine compliance wit h Product  perf ormance and reliabilit y 
specificat ions.

10. ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESS 
FOR A PARTICULAR PURPOSE OR USE, SHALL BE LIMITED TO THE 
DURATION OF THE FOREGOING LIMITED WRITTEN WARRANTY. 
OTHERWISE, THE FOREGOING LIMITED WARRANTY IS THE 
CONSUMER'S SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF 
ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. NMP SHALL NOT 
BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL 
DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF 
ANTICIPATED BENEFITS OR PROFITS, LOSS OF SAVINGS OR 
REVENUE, PUNITIVE DAMAGES, LOSS OF USE OF THE PRODUCT OR 
ANY ASSOCIATED EQUIPMENT, COST OF CAPITAL, COST OF ANY 
SUBSTITUTE EQUIPMENT OR FACILITIES, DOWNTIME, THE CLAIMS 
OF ANY THIRD PARTIES, INCLUDING CUSTOMERS, AND INJURY TO 
PROPERTY, RESULTING FROM THE PURCHASE OR USE OF THE 
PRODUCT OR ARISING FROM BREACH OF THE WARRANTY, 
BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY 
OTHER LEGAL OR EQUITABLE THEORY, EVEN IF NMP KNEW OF THE 
LIKELIHOOD OF SUCH DAMAGES. NMP SHALL NOT BE LIABLE FOR 
DELAY IN RENDERING SERVICE UNDER THE LIMITED WARRANTY, 
OR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS 
BEING REPAIRED.

11. Some st at es do not  allow limit at ion of  how long an implied 
warrant y last s, so t he above one- year warrant y limit at ion may 
not  apply t o you (t he Consumer). Some st at es do not  allow t he 
exclusion or limit at ion of incident al and consequent ial damages, 
so cert ain of t he above limit at ions or exclusions may not  apply t o 
you (t he Consumer). This limit ed warrant y gives t he Consumer 
specific legal right s and t he Consumer may also have ot her right s 
which vary from st at e t o st at e.

12. NMP neit her assumes nor aut horizes any aut horized service 
cent er or any ot her person or ent it y t o assume f or it  any ot her 
obligat ion or liabilit y beyond t hat  which is expressly provided for 
in t his limit ed warrant y including t he provider or seller of  any 
ext ended warrant y or service agreement .
